Below is a copy of a recent letter from the lawyer representing Axa Pacific Insurance regarding this website.


As you are aware, we are solicitors for Axa Pacific Insurance Company (Axa") and are representing Axa in relation to a fire which occurred at the premises of your client, David Johnson, on September 10, 2007.


We are writing to you with respect to false and malicious statements made by Mr. Johnson about Axa and the insurance adjuster retained by Axa, Jerry Cox, which are currently published on a website created and operated by him at http://.deniedinsurance.net. The subject matter of Mr. Johnson's defamatory statements concern Axa's denial of coverage for damages resulting from the fire at Mr. Johnson's residence. Since you are counsel for Mr. Johnson in the ongoing insurance dispute, we are corresponding with you directly.

Above is the cheque which arrived by registered mail following the statements by the lawyer for Axa Pacific Insurance


Mr. Johnson has published on his website statements claiming that the independent adjuster retained by Axa to investigate this fire (Mr. Cox) planted evidence to interfere with the investigation, and that Mr. Cox engaged in and was motivated by racial discrimination when doing so. These allegations are completely false and without foundation in fact whatsoever and were made with the intention of conveying to the readers of the site that Axa, through its adjuster, engaged in illegal and immoral activity as a means to deny coverage to one of its insureds.


Mr. Johnson has also maliciously published statements claiming that in addition to wrongfully denying coverage, Axa expressed to him that the reason for denying coverage was that Mr. Johnson "never appeared at their office whatsoever". Mr. Johnson characterized Axa's conduct as "illegal". These allegations are completely unfounded. As you are aware, Axa denied coverage as a result of Mr. Johnson misrepresenting material facts at the time of the application for insurance, namely that his premises were not being used for business purposes when, in fact, the basement suite of his premises was being rented to an individual who did not reside at the premises and who was operating a business from within the premises. Axa, through our office, duly provided Mr. Johnson with notification of the denial of coverage in our letter dated November 15, 2007.


Mr. Johnson's intended imputation that Axa and Mr. Cox participated in an illegal and immoral scheme to deny an insured coverage constitutes the most devastating and false attack on Mr. Cox's professional reputation and our client's reputation with its insureds, potential insureds, and within the insurance community generally. Mr. Johnson has made these imputations with the intention of harming Mr. Cox's reputation and our client's longstanding reputation as a leading corporate citizen and provider of financial protection to its insureds. If Mr. Johnson has concerns with respect to the denial of coverage, we expect that those concerns will be addressed within the legal proceeding which he has flied with the court.


We demand that Mr. Johnson forthwith:


1. remove his website, http://www.deniedinsurance.net, in its entirety from the internet; and


2. desist from any further insinuations of this kind outside of the legal proceeding currently before the courts.


Our client reserves all legal rights to protect its reputation and that of its adjusters and further action will be governed by your response to this letter. We further place Mr. Johnson on notice that any further publication or republication in any form outside of the legal proceeding following delivery of this notice will aggravate damages.

2 Updates:  The video above was removed and replaced as was the video to the adjuster on the adjuster movie page by someone attempting to keep these movies from going public.


Axa Pacific Insurance has refused to turn over the discovery documents for the upcoming trial. What’s being requested of them is the pictures that were taken of my home the night of the fire by the adjuster, the names and pictures of the 2 forensic men who arrived at my home near 12:00 AM, a copy of the digital recording which was recorded at his office 4 days after the fire which contains exculpatory evidence and more. 


If you notice in the letter above the lawyer speaks of racial discrimination in an attempt to give the impression that I am attempting to use race as a means to advance my case and if you read very carefully on my About Me page you will see that I have clearly stated that I have no racial issues with Axa Insurance. Their action here is to make this case look like I am a man that continually uses race as a means of advancement and it would explain why Jerry Cox came back to my house the next morning after the fire asking to see those posters where he tried to talk me into placing more posters like the ones he photographed on my fence regarding this case. He knew he made a major mistake when I didn’t pick up, hide or discard that gas cap. He said:


“ Wow, these posters are something else, if you put posters like these out there you will really shake things up”.

As far as their comments about keeping things within the legal proceedings it is my right to know who the adjuster had in my home as well as information regarding my file. I now have to go to court to demand that they turn over the Documents for Discovery
